A New York personal injury law firm, David Resnick & Associates, P.C., has secured a $1.925 million settlement for a 38-year-old woman who suffered severe injuries after slipping on a wet and slippery staircase in her building. The settlement was reached before trial by attorney Philip Monier, who has over 25 years of experience representing accident victims.

The lawsuit, filed in the Supreme Court of the State of New York, New York County, alleged that the woman sustained tears in the labrum of both hips, as well as injuries to her spine and neck. Following the accident, she required several months of rehabilitation and surgery to repair the hip tears. Her injuries significantly limited her ability to perform daily activities such as walking, bending, and sitting, and prevented her from completing household chores, standing or sitting for long periods, or enjoying activities with her children.

The building owner and managing agent argued that the fall occurred during a period of snow and cold weather, claiming they were not required to cover all floors with mats or continuously remove moisture tracked onto the stairs. They also asserted that they did not create the wet conditions and lacked notice of them. However, Monier was prepared to call medical and economic experts to demonstrate the extent of the woman's injuries and their long-term impact on her life.

“When an accident happens as a result of someone's negligence or failure to use reasonable care, the injured party deserves to be fully compensated not only for what that person has gone through since the date of the accident, but also for what the person will go through in the future, for the rest of that person's life,” Monier said. “The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties.”

This case underscores the importance of premises liability, particularly during inclement weather when property owners must take reasonable steps to prevent hazardous conditions.
