David Resnick & Associates, P.C., a personal injury law firm serving clients throughout New York City, announced that trial attorney Philip Monier has obtained a $2,500,000 pre-trial settlement on behalf of a Bronx woman who suffered catastrophic injuries when a commercial vehicle struck the vehicle she was driving. The settlement underscores the significant impact of legal representation in cases involving severe, life-altering injuries.
According to the law firm, the lawsuit was filed in the Supreme Court of the State of New York, Bronx County, demanding compensation for the 43-year-old woman's serious injuries, which included a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures. The woman also suffered herniations and protrusions at multiple levels of her spine, along with nerve damage, leaving her permanently disabled and unable to work, as recognized by the federal government.
Before the accident, the woman worked as an occupational therapy assistant, a physically demanding job that required helping patients with balance and strengthening exercises and lifting some weighing 200 pounds or more. The injuries severely limited her ability to perform daily activities, including walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores. The firm stated that the physical toll was devastating, requiring major surgical intervention and a challenging road to recovery.
Monier noted, "We are incredibly pleased to have secured this settlement for our client, whose life was completely turned upside down by this crash." He added that the settlement provides financial peace of mind, covering ongoing medical care, specialized rehabilitation, and long-term support.
The defense was prepared to argue that the woman's injuries were pre-existing and not caused by the crash, and that she was not disabled or impaired because any injuries had fully healed. However, the firm was prepared to counter that the accident was a substantial factor in causing her injuries and that any pre-existing conditions were exacerbated by the collision. They also planned to show that the woman remained permanently disabled and would need ongoing treatment and future surgical care.
This settlement follows other successful cases by Mr. Monier, including a $1.925 million settlement for a staircase slip and fall (announced June 20, 2026) and a $1.3 million settlement for a fall outside an elevator (announced July 25, 2026). David Resnick & Associates, P.C., based in Midtown Manhattan, has represented clients throughout New York City since 1998, handling a range of personal injury matters such as slip-and-fall accidents, auto accidents, pedestrian injuries, subway and escalator accidents, tenant injuries, construction injuries, and other negligence claims. The firm strives to maximize compensation for clients' damages.
